Terms of Service

These Terms of Service (“Terms”) govern your access to and use of HERSHAPE (the “App”), a women’s fitness mobile application providing workout programs, progress tracking, and related features. By downloading, installing, or using HERSHAPE, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use HERSHAPE. If you are between 13 and the age of majority in your jurisdiction, you may only use the App with the consent of a parent or legal guardian. By using HERSHAPE you represent that you meet these requirements.

2. Your Account

To access certain features you must create an account. You agree to provide accurate information, keep your credentials secure, and notify us promptly if you suspect unauthorized use of your account. You are responsible for all activity that occurs under your account.

3. Subscriptions and Purchases

• HERSHAPE offers auto-renewing subscriptions and one-time purchases through the applicable mobile app store. Pricing, billing cycle, and renewal terms are shown at checkout.
• Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before renewal through your app store account settings.
• Payments are processed by the app store, and refunds are handled according to the app store’s refund policy. We do not control and cannot directly issue store-based refunds.
• We may change pricing or plan features. Changes will not apply retroactively to an already-paid billing period and will be communicated before they take effect.

4. Health and Fitness Disclaimer

HERSHAPE provides general fitness content for informational and educational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for the advice of a qualified healthcare or fitness professional. You should consult a physician before beginning any new exercise program, especially if you are pregnant, nursing, have any medical condition, or are taking medication.

You use the App and perform any exercises at your own risk. Stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other symptom that concerns you.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful, harmful, or fraudulent purpose.
• Reverse engineer, decompile, or attempt to extract source code from the App.
• Copy, redistribute, resell, sublicense, or publicly display App content without written permission.
• Circumvent paywalls, subscription checks, or any other security or access controls.
• Upload or transmit viruses, malware, or other malicious code.
• Interfere with or disrupt the App, its servers, or related services.
• Use automated tools, scrapers, or bots to access or collect data from the App.
• Share your account credentials or use another person’s account without authorization.

6. User Content

If the App allows you to submit content (such as notes, progress entries, or feedback), you retain ownership of that content. You grant us a worldwide, royalty-free license to host, store, and process it solely to operate and improve the App. You are responsible for the content you submit and confirm that it does not violate anyone’s rights or applicable law.

7. Intellectual Property

The App, including its workout programs, videos, text, graphics, logos, and software, is owned by HERSHAPE and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. All rights not expressly granted are reserved.

8. Third-Party Services

The App integrates with third-party services (including Supabase, RevenueCat, Expo, YouTube, and Railway). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content, availability, or practices of third-party services.

9. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the App will be error-free or that specific fitness results will be achieved.

10. Limitation of Liability

To the maximum extent permitted by law, HERSHAPE and its operators, contributors, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from or related to your use of the App. Our total aggregate liability for any claim related to the App will not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) USD 50.

11. Indemnification

You agree to defend, indemnify, and hold harmless HERSHAPE and its operators from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the App at any time. We may suspend or terminate your access to the App, with or without notice, if you violate these Terms, misuse the App, or if we are required to do so by law. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

13. Changes to the App or Terms

We may update, modify, or discontinue features of the App at any time. We may also update these Terms to reflect changes to our practices, the App, or applicable law. When we make material changes we will update the effective date above and, where appropriate, notify you through the App. Your continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App will be resolved in the competent courts of that jurisdiction, except where applicable consumer-protection laws grant you the right to bring a claim in your place of residence.

15. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and HERSHAPE regarding the App and supersede any prior agreements on the same subject.
